Terms of Use
Last updated: 12 September 2026
These terms govern your use of TrackFit — the India-first running and walking app, this website, and related services such as share cards and referral links. Please read them with the Privacy Policy.
This is a product-aligned draft for App Store and Google Play listings, not a full legal opinion. The operator’s registered legal name is [TRACKFIT LEGAL ENTITY NAME] — to be confirmed by counsel. Until then, “TrackFit”, “we”, and “us” mean the team that operates the app and this website. Governing law: India. Default timezone: Asia/Kolkata.
1. Acceptance of terms
By creating a TrackFit account, downloading the app, or using this website, you agree to these terms. If you do not agree, do not use TrackFit. If you use TrackFit on behalf of an organisation (for example an office or campus challenge), you also confirm you are allowed to do so.
2. Eligibility and your account
You must be at least 18 years old and able to form a binding contract under Indian law. TrackFit accounts are created with a phone number via OTP (India +91). You are responsible for that number, for keeping OTP codes to yourself, and for activity that happens on your account. Tell us promptly at support@trackfit.in if you lose access to the number or think someone else is using your account.
One person should not create many accounts to game streaks, challenges, or referrals. We may refuse, merge, or close accounts that look automated or abusive.
3. Licence to use TrackFit
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the TrackFit app and website for their intended purpose — recording and sharing your own running and walking, and taking part in the community. You do not buy the software; the App Store and Google Play licence terms also apply to the copy you install. You may not copy, reverse engineer, or resell TrackFit except as Indian law expressly allows.
4. Acceptable use
You agree not to:
- harass, threaten, defame, or abuse other people, or post illegal or sexual content involving minors;
- upload malware, scrape the service, overload our APIs, or interfere with how TrackFit runs;
- impersonate someone else, or present another person’s runs as your own;
- use fake GPS, spoofed routes, or other location-spoofing to inflate distance, win challenges, or mislead the community — that is prohibited misuse;
- try to access another user’s private activities, photos, or account data;
- use TrackFit for any purpose that is illegal in India.
We may remove content or limit features when we reasonably believe these rules were broken.
5. Your content
You keep the rights in content you create on TrackFit — activities, titles, photos, comments, and profile information. You grant TrackFit a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content as needed to operate the service: to save your run, show it to people allowed by your privacy setting, generate a share card you request, or display it in a challenge you joined.
That licence lasts for as long as the content stays on TrackFit. If you delete an activity or close your account, we will stop displaying it, subject to backups, caches, and copies other people may have already saved (for example a screenshot of a share card). You confirm you have the right to upload what you post, including photos of other people.
6. Community rules
The feed, follows, kudos, and comments are meant to feel like a running circle, not a dumping ground. Be decent. Do not pile on, doxx, or use comments to advertise spam. Private accounts and follow requests exist so people can keep a smaller circle. We may hide, limit, or remove content or accounts that make the community unsafe. Reporting tools are there for a reason — do not misuse them.
Organisation and workplace challenges are for group progress, not surveillance. Do not use an org admin role to pressure colleagues into sharing private routes or photos.
7. Challenges, referrals, and rewards
Streaks, XP, quests, squad challenges, organisation challenges, share cards, and referral invite links (trackfit.in/i/{code}) are informational and gamification features. They exist to help you show up. Unless we separately and clearly state a prize, there is no guarantee of rewards, cash, or merchandise. We may change, pause, or end a challenge, leaderboard, or referral mechanic. Leaderboards can be wrong; we may adjust them if we believe there was cheating or a technical error.
8. Third-party services
TrackFit relies on other platforms you may already use:
- Apple HealthKit and Android Health Connect, if you connect them;
- Mapbox maps and Open-Meteo weather;
- Apple App Store and Google Play;
- Firebase, hosting, file storage, and push notification providers described in the Privacy Policy.
Those services have their own terms. We are not responsible for Health, maps, or store outages we do not control. Connecting a health platform is optional; revoking it in your phone settings will stop that sync.
9. Fitness disclaimer
Running and walking are at your own risk. TrackFit is not a medical device and does not give medical advice. Weather, heat, AQI, or coaching-style tips in the app (including any future AI coach) are informational. You decide whether, when, and how hard to move. Check with a qualified clinician if you have a health condition. We are not liable for injury, illness, or property damage that happens while you use the app or follow a suggestion in it, except where Indian law says we cannot exclude that liability.
10. Limitation of liability
TrackFit is provided “as is”. We do not promise uninterrupted GPS, perfect maps, or that every activity will save after a crash — though we try to make recording resilient. To the fullest extent Indian law allows, we are not liable for indirect, incidental, or consequential losses (lost streaks, lost challenges, lost data, or lost profits). Our total liability for a claim relating to TrackFit is limited to the amount you paid us for the app in the twelve months before the claim, or ₹1,000 if you paid nothing — unless a mandatory consumer-protection rule says otherwise. Nothing in these terms limits liability for fraud or for death or personal injury we cause by negligence where the law does not allow that limit.
11. Ending or suspending your account
You may stop using TrackFit and ask us to delete your account by emailing support@trackfit.in. We may suspend or close an account that breaks these terms, harms other users, or creates legal risk. We may also stop offering part or all of the service. After closure, your licence ends. Sections that naturally survive (content licence for residual copies, disclaimers, liability limits, and governing law) continue to apply.
12. Changes to these terms
We may update these terms as the product changes. The “Last updated” date at the top will change when we do. If a change is material, we will try to notify you in the app or on this website. If you keep using TrackFit after an update, you accept the new terms to the extent the law allows. If you do not accept them, stop using the app and request deletion.
13. Governing law and disputes
These terms are governed by the laws of India. Courts in India have exclusive jurisdiction, subject to any mandatory consumer-protection venue rules that apply to you. Before filing a claim, please write to support@trackfit.in so we can try to resolve it.
